General Terms and Conditions of Sale

1. Scope

The purpose of these general terms and conditions of sale is to provide and define all the necessary information for the user on the ordering, sale, payment and delivery methods for purchases made on the website www.beiraportal.pt, owned by:

Beiraportal, Produtos de Madeira Lda., with registered office at Estrada Nacional Nº2 - Fontainhas, 3510-939 Viseu - Portugal, NIPC no. 504 422 030 and Share Capital: € 535.000,00.

These general terms and conditions of sale are the only ones applicable and supersede all other terms and conditions, unless expressly agreed in writing in advance.
By validating an order, the user is deemed to accept these general terms and conditions of sale.

2. Product

The product images available on the website are as accurate as possible, in order to reproduce the product identically as it is in reality. Bearing in mind that some products are handmade, there may be slight differences between the image and the actual product, due to the raw materials themselves and the production process.

3. Ordering

3.1 Order fulfilment

The products on the website are only available for sale in mainland Portugal (excluding islands or other territories not mentioned).

To place an order on the site, you just need an e-mail account and follow the steps below:

- Select the products you want to buy and add them to your shopping basket;

- Register online to create a personal account where you can access and update your personal details at any time and check the status of orders or returns;

- Fill in all the mandatory fields and select the payment option you want;

- Accept the General Terms and Conditions of Sale and click on "Checkout";

- At the end of the order you will see a screen with the order confirmation and details, which you can print out. You will also receive an automatic email with this information.

By submitting your order, you accept the site's General Terms and Conditions of Sale, as well as the Privacy and Personal Data Protection Policies (Legal Notices) which appear in the footer of the site.

3.2 Failure to process the order

Beira Portal reserves the right not to process orders without a guarantee of good collection, or if orders are incomplete or incorrect, or if the product is no longer available. In these cases, the user will be informed by e-mail of the cancellation and the amount paid by the user will be refunded.

Beira Portal also reserves the right to cancel any order, even if successfully placed, and disclaims liability for damages or costs, if any of the following situations occur:

- Product unavailable (in this case, the amount paid by the user will be refunded using the same payment method used for the order);

- Incorrect billing information;

- Payment for order not received (up to 8 working days after order);

- Error in the price of the product;

- Delivery of parcel not achieved at the address indicated for dispatch.

4. Product availability

The fulfilment of orders placed on the website is subject to the availability of stock of the products.

If a particular product is out of stock or if the customer has placed an order for a product that has since sold out, Beira Portal will send the available items and the customer will be reimbursed for the out-of-stock items.

5. Price

Product prices are those published on the website, unless there is a clear error. The site is updated daily, however, it is possible that the information on the price of some products contains errors, so in the event of this situation, Beira Portal will inform the user as soon as possible, giving the user the possibility to confirm the order with the correct price or cancel it, with the right to a full refund of the amount paid. If it is not possible to contact the user, Beira Portal reserves the right to cancel the order and refund the full amount.

The prices shown on the website already include Value Added Tax (VAT), according to the legislation applicable in the country where the order is placed.

If the user wishes, they can request home delivery of the order, with an additional cost relating to the delivery fee, which is added to the value of the product. If the order exceeds the minimum value set for the country in which the order is placed, delivery will be free (except for products for exclusive home delivery which, due to their characteristics, weight or volume, have an associated delivery charge).

The Total Amount Payable is the value of your order including VAT and the delivery charge.

Product prices are subject to change and update. Beira Portal reserves the right to change prices without prior notice. However, the price displayed at the time of purchase is the price actually applied, unless there is a clear error.

6. Payment methods

In order to offer the most convenient solutions for the user, the site offers the following payment methods:

- VISA/MASTERCARD credit card;

- MB WAY;

- Multibanco reference (Portugal);

If you choose to pay by credit card/PayPal/MB WAY, all the payment information is filled in directly on the secure page of the electronic payment service provider. Beira Portal is not responsible for any delays or non-delivery of orders due to checks and authorisations by the issuing entities.

The invoice will be sent to the user by e-mail, in PDF format, when the order is dispatched/delivered. By placing your order, you accept this condition.

7. Shipping and delivery

7.1 Sending

Orders will be dispatched after confirmation that payment has been made.

7.2 Delivery

Users have two delivery options for their order: home delivery or collection from the Beira Portal showroom.

The home delivery service is carried out by courier and operates on working days between 9am and 6pm.

Delivery times (except for reasons of force majeure) are between 5 and 7 working days.

Note: Delivery time estimates are valid after confirmation that orders have been paid in full.

The home delivery service and its process:

The courier informs the user, via SMS or e-mail, of the expected delivery date, and it is possible to change this date or choose to pick up the parcel at a nearby collection point. The courier will deliver the parcel to the address selected by the user. For orders that include products for exclusive home delivery (products with special characteristics or high weight or volume) these products may have a different delivery time. Upon receipt of the items, the customer must confirm the entire order in the presence of the courier. In the event of a defect/damage/item not matching the order, the customer must note this on the carrier's delivery note.

 

8. Cancellations and Returns

8.1. Order cancellation

Depending on the status of the order, the user can cancel it as long as it has not yet been dispatched. To find out if you can cancel your order, please contact us using our online form.

8.2 Return for withdrawal

The user has a 14-day cooling-off period during which they can return the product if they are not satisfied, provided that:

- The product has not been used or tampered with;

- The product retains its original characteristics and the packaging is not completely damaged;

- The product is not for Christmas;

- The product is complete and properly packed in its original packaging;

- Attach the printed invoice and returns document.

To start the return process, the user must contact Beiraportal.

 

8.3 Returns due to product non-conformity

If, within 30 days of picking up/receiving the order, the user detects any manufacturing non-conformity in the product, they may return it, following the procedures described above.

8.4 Form of reimbursement

The value of the products to be returned will be refunded using the same payment method as for the online order (ATM reference, Credit Card, MB WAY).

If payment has been made by ATM reference, the refund will be made by bank transfer, and the user must indicate their IBAN for this purpose.

For Credit Card payments, the user should check their credit card statement. If you have used MB WAY to pay for your online order, you should check your MB WAY account balance.

The refund will be made within a maximum of 14 days from the date of receipt of the product at Beiraportal.

9. Product guarantee

The guarantee for a product is valid from the date of purchase on the website, for 2 years, on presentation of the purchase invoice. Products that have been misused or incorrectly handled/applied by the user are excluded from the scope of the guarantee.

To activate the guarantee, the user must go to one of our shops or contact us via our online form.

10. Campaigns and Promotional Codes

Whenever there is a campaign running on the site, its specific conditions such as user eligibility, duration, exclusions, etc. will be duly detailed on the relevant campaign page. Campaigns available on the site and promotional codes are only valid for purchases made on this site.

11. Changes

Beiraportal may, at any time and without prior notice, amend these conditions or, where appropriate, introduce new conditions by publishing them on the website, so that they can be known by the user when they access it and before they use it. The validation of the order, once the applicable changes have been made, will signify the user's acceptance of these modified conditions.

12. Exclusion of Guarantees and Liability

Beiraportal warns that, even though the site is updated with extreme care, it is possible that the information on the products and their price may contain errors, so it does not commit to the offer and reserves the right to cancel the user's order if such an error occurs.

Beiraportal will only be liable for any damages that the user may suffer as a result of the online sales service when these are attributable to its wilful misconduct, the user recognising and accepting that the use of this service is carried out under their sole responsibility and risk. In jurisdictions that do not allow the exclusion or limitation of certain guarantees, Beiraportal's liability will be limited to the extent permitted by law.

13. Processing of Personal Data

The user authorises the processing of the personal data provided by the purchase order, in particular through the use of cookies, under the terms set out in the Legal Notices.

14. Customer Support

Please send us your questions and suggestions, as well as any complaints or claims via our online form.
Your complaints and claims will be dealt with as quickly as possible and, in any case, within a maximum of one month.
If, as a consumer, you feel that your rights have been violated, you can send us your complaint via our online form to request an out-of-court dispute resolution.
